2What is in the contract between A and B? Is there any waiver of liability? Any guarantees, insurance, etc, etc? Without that, it's impossible to answer. Since B is not an official mail carrier (postal service, under the UPU). This question needs more details.Mindwin Remember Monica– Mindwin Remember Monica2025-11-28 12:51:26 +00:00Commented 2 days ago

3All: this is fairly standard hypothetical asking how the common law would apply to the terms described in the question, ignoring potential effects of other non-mentioned elements of a broader contract. It is possible to answer assuming only the stated facts. Unrealistic facts can be part of the hypo. If an answer assesses effects of additional or different terms, they should clarify they are making additional or different assumptions, but should not "criticize a question for containing unrealistic or far-fetched facts."Jen– Jen ♦2025-11-28 15:36:35 +00:00Commented 2 days ago

2You say the market value of the delivery is $10. But is that the market value of an overnight delivery, or of a 2-day delivery (or whatever the actual time was)? You'd expect them to be different.Nate Eldredge– Nate Eldredge2025-11-28 18:36:09 +00:00Commented 2 days ago

How to Tag
A tag is a keyword or label that categorizes your question with other, similar questions. Choose one or more (up to 5) tags that will help answerers to find and interpret your question.
- complete the sentence: my question is about...
- use tags that describe things or concepts that are essential, not incidental to your question
- favor using existing popular tags
- read the descriptions that appear below the tag
If your question is primarily about a topic for which you can't find a tag:
- combine multiple words into single-words with hyphens (e.g. united-states), up to a maximum of 35 characters
- creating new tags is a privilege; if you can't yet create a tag you need, then post this question without it, then ask the community to create it for you
