  • Last weeks, we shared that Evan Trapp and Mikenna Richardson would be speaking at the 2026 American Association of Port Authorities Annual Convention & Expo. Now we're here in New Orleans! Our team has had a great time connecting with port authorities, terminal operators, logistics providers, and supply chain professionals from across North America. Alongside Evan Trapp and Mikenna Richardson, Jacob Walker is also on site meeting with industry leaders and discussing the trade and compliance challenges shaping cargo movement today. During their session, Mikenna Richardson spoke about a challenge we're seeing more frequently across the industry. Cargo can be physically ready to move, but documentation and compliance requirements can create costly delays. As trade rules continue to evolve, compliance is no longer a one-time exercise. Businesses need living documentation processes, real-time regulatory monitoring, strong internal coordination, and clear communication across departments to keep freight moving efficiently. One insight that resonated with attendees was that terminal technology can track where a container is, but it cannot track the legal status of the goods inside. When documentation falls behind regulatory changes, the result can be increased dwell time, tied-up equipment, demurrage costs, and operational disruption. Across both days, she will also co-facilitate roundtables on avoiding item misclassification, including the dual use vs. defense question and the risks of relying on Al for HS and ECCN classification.   • We noticed there has been quite a bit of talk about the U.S.-China deal and we wanted to break down what manufactures, importers and exporters can expect as a result. Two pieces of news this week point the same direction: reduced trade tension between the U.S. and China, but nothing that changes anyone's cost structure yet. The facts: the U.S. and China have agreed to tariff relief covering roughly $30 billion of trade in each direction. China would ease tariffs on categories like small appliances, toys, and decorations. The U.S. side covers agricultural products, meat, dairy, cosmetics, and similar consumer goods. Separately, a U.S.-China Board of Trade has been floated to cut tariffs on goods categorized as "non-essential," think artificial flowers, Christmas ornaments, billiard balls, bathroom scales, fish hooks. And the broader U.S.-China tariff truce has reportedly been extended for another two months. Who this could benefit: importers and retailers in the named categories, on both sides, if and when it's finalized. American farmers and ag exporters stand to gain from the agricultural relief. Consumer goods importers dealing in the "non-essential" list could see modest duty relief on specific product lines. Why we're not popping champagne yet: an announcement is not a Federal Register notice. Until specific HTS numbers, effective dates, and entry-vs-export-date rules are published, there's no way to know which shipments actually qualify, whether it applies to goods already on the water or sitting in FTZ inventory, whether relief stacks with existing duty programs, or what exclusions apply. A two-month truce extension is also not a resolution. It's a pause, and pauses in this environment have a track record of getting revisited. Our take: this is good news worth watching, not a green light to rebuild your sourcing plan around it. If you're in one of the affected categories, now's the time to identify your exposure and be ready to move once the details land, not to assume the relief is locked in. Keep an eye on your surroundings, stay flexible, and don't put all your eggs in one basket until it's in writing. #TradePolicy #Tariffs #USChinaTrade #SupplyChain #Importers

  • 🚨 SECTION 338 UPDATE: U.S. IMPORT BANS TAKE EFFECT SEPTEMBER 29 Effective 12:01 a.m. ET on September 29, 2026, the United States will prohibit the importation of certain Canadian products in the alcoholic beverage, dairy and motor vehicle sectors under Section 338 of the Tariff Act of 1930. This marks a significant escalation from the 50% additional Section 338 duties that took effect August 22. Importantly, this is not a blanket ban on all Canadian alcohol, dairy products or motor vehicles. The prohibitions apply to specific products identified in the Presidential Proclamations. Other products may remain subject to the 50% additional Section 338 duty rather than being prohibited from importation. For Canadian exporters, HTS classification is now even more critical. Depending on the product and classification, goods may be: • Prohibited from entering the United States • Subject to the 50% additional Section 338 duty • Outside the affected Section 338 provisions Canadian exporters should review their U.S. classifications and Section 338 exposure immediately, particularly for shipments moving across the border on or after September 29.   • A major U.S. pharmaceutical tariff change takes effect September 29. Beginning September 29, 2026, the next phase of the U.S. Section 232 pharmaceutical tariffs takes effect for patented pharmaceuticals and associated pharmaceutical ingredients. For covered products, the impact can be significant, with a 100% combined tariff rate unless another applicable treatment applies. But not every pharmaceutical product will face the 100% rate. Generic pharmaceuticals and their associated ingredients are not currently subject to the pharmaceutical Section 232 tariffs, while certain products may qualify for zero or reduced-rate treatment depending on classification, product status, company arrangements and other applicable provisions. For Canadian exporters, this means the analysis needs to happen before the next U.S. entry. Canadian origin or CUSMA eligibility alone should not be assumed to eliminate Section 232 exposure. Companies should be reviewing: • HTSUS classification • Patented versus generic status • Annex I scope • Annex IV zero-rate treatment • Country of origin • Company-specific treatment • Applicable Chapter 99 reporting The September 29 effective date is based on when goods are entered for consumption or withdrawn from warehouse for consumption, not simply when they are shipped.
