Special terms and conditions for the bigSMALL forum

Employees, and their immediate families, of Toyota, The Independent and their agencies are not eligible to enter. All entries must include name, e-mail address and daytime contact telephone number. Closing date for receipt of entries is midnight 17/08/06. The winner will be notified on 18/08/06 by e-mail/phone. The winner will be the person that, in the opinion of The Editor, posts the most inspired, thought-provoking opinion. The editor's decision is final and no correspondence will be entered into. The Independent reserves the right to publish the surname and county of the winner, the winner may be asked, but is not required, to take part in publicity. The winner will be required to produce and have an article published in The bigSMALL Guide 2, Saturday 9 September. The winner will be required to submit their article by Monday 21 August. Winner to be briefed by The Independent. The article is subject to final approval by The Independent and The Editor. The winner will also receive a Panasonic 37in Viera HD Compatible Plasma TV. Delivery is included, however the prize does not include installation. The two other prizes are one Apple iPod 60GB with video (product code 300470) and one Panasonic 37in Viera HD Compatible Plasma TV. The winners of these two prizes will be awarded to readers who have registered their vote on the poll generator. Winners will be the first two names drawn from the "hat". Entrants must be UK or Isle of Man residents, aged 18 or over. No cash alternatives will be offered. Only one entry per household. No purchase necessary. The prizes are subject to availability. The Independent will not be liable for any circumstances beyond its reasonable control that prevent a prize being taken up by a winner. Any personal information collected may be used for marketing and research purposes by The Independent or Toyota and may be passed on to third parties for these. The Independent wishes to encourage the broadest exchange of news and information to encourage stimulating, informative and above all intelligent debate. To ensure the debate flows freely with only minimal intervention required of a respected publisher access to and use of any forum hosted by The Independent website is subject to the following terms and conditions.

4. By submitting any contribution to The Independent website:-

(1) you warrant that your contribution

· is your own original work and that you have the right to make it available to The Independent for all purposes.

· does not infringe any law

(2) you indemnify The Independent against all damages, legal fees and others expenses that may be incurred by The Independent as a result of your breach of warranty.

5. You agree to use The Independent website only for lawful purposes and in a way that does not infringe the rights of or restrict or inhibit anyone else's use and enjoyment of the website. Contributions must be civil and tasteful.

The following are examples (but not an exhaustive list) of behaviour/action which is prohibited:-

· material which is sexist, racist, homophobic, obscene or likely to harass or cause distress or be disruptive

· swearing

· multiple posting

· advertising

6. You must not reveal any personal information about yourself or anyone else (for example telephone number, home address or email address).

8. The Independent reserves the right to delete any contribution at its sole discretion at any time without notice.

9. You may not copy, reproduce, re-publish, download, post broadcast, transmit, make available to the public or otherwise use the content of The Independent website in any way except for your own personal, non-commercial use, not adapt or to create a derivative work from any Independent content except for your own personal non-commercial use.

The Independent will not be liable for any loss including but not limited to the following (whether such losses are foreseen, known or otherwise) loss of data, loss of revenue or anticipated profit, loss of business, loss of opportunity, loss of goodwill or injury to reputation, losses suffered by third parties, any indirect, consequential or exemplary damages

13. These terms shall be governed and interpreted in accordance with the laws of England and Wales.
