Amy’s Kitchen, LLC (“Amy’s”) is providing this notice to job applicants regarding the collection of personal information (“Privacy Notice”) to comply with applicable consumer privacy laws.  Applicants with disabilities may access this notice in an alternative format by contacting privacy@amys.com.

Amy’s is committed to protecting the privacy and security of personal information.  We ask job applicants and prospective employees to provide personal information necessary related to your application or prospective employment.  This Privacy Notice describes how Amy’s collects and uses your personal information, the categories of personal information we collect, and instances where Amy’s may disclose your information to third parties.  Amy’s will only collect and process your personal information in accordance with this Privacy Notice, unless otherwise required by applicable law. All online recruitment and hiring with Amy’s is conducted through our third-party vendor, UKG, Inc. (“UKG”). UKG's privacy notice can be found here.

Categories of Personal Information Amy’s Collects and How We Use It

Amy’s collects and processes information from you for human resources, employment, and benefit administration purposes, and where necessary to comply with any federal, state, and/or local legal obligations.   We collect personal information from the following categories of sources:

  • Directly from you during the job application process, employee onboarding process, and benefit selection
  • From your references and former employers (with your consent)
  • From background check and consumer reporting agencies (after an employment offer is made)
  • From recruitment agencies or job boards where you submitted your application
  • From publicly available sources such as professional networking sites

In some cases, Amy’s may obtain a background check and/or a consumer report from a consumer reporting agency once an employment offer is made.

Amy’s collects the following categories of your personal information:

  • Identifiers, including your first and last name, your address, your email address, telephone number, date of birth, social security number, driver license number, passport number, and/or other government identification numbers, immigration and work authorization status, signature, and username and/or account name.  Amy’s collects this information to make employment and/or job-related decisions involving you, to fulfill or meet the reason you provided the information, to manage your prospective employment relationship with us and to create, maintain, and secure your online accounts with Amy’s.
  • Protected Classification Information such as age, race, color, national origin, citizenship, marital status, physical or mental disability, sex (including gender, gender identity, sexual orientation, and/or gender expression) and veteran or military status.  Amy’s collects this information on a voluntary basis to comply with local, state, and federal laws and regulations.
  • Professional or Employment Information such as current or past employment history, employee status and title, employment status, performance evaluation information, and termination information. Amy’s collects this information to make an employment and/or job-related decision that involves you, to fulfill or meet the reason you provided the information as a job applicant or employee, to provide you with employment with Amy’s, to assess qualifications for a particular job or task, and for other human resource administration purposes.
  • Education Information such as education history.  Amy’s collects this information to evaluate and make an employment and/or job-related decision that involves you, to provide you with employment with Amy’s, and to assess qualifications for a particular job or task.

Sensitive Personal Information

Amy’s collects and processes data considered “sensitive personal information” from applicants on a voluntary basis only. Such information includes:

  • Racial or ethnic origin to comply with statutory obligations.
  • Physical or mental health condition or disability status.

Additionally, if you are offered a role with Amy’s, Amy’s will collect the following sensitive personal information for the sole purpose of carrying out our obligations under immigration or other employment law:

  • Social security, driver’s license, state identification card, or passport number.

Amy’s will not disclose your sensitive personal information to any party that does not have a legitimate need to know and will only use your sensitive personal information for the purposes set forth herein.

Disclosure to Third Parties

Amy’s does not sell or otherwise disclose your personal information to any third parties for monetary or other valuable consideration.  Under applicable state privacy laws, “sale” means the exchange of personal information for monetary or other valuable consideration. Amy’s also does not share your personal information for cross-context behavioral advertising purposes, which may be considered “sharing” under certain state laws. Amy’s only shares your personal information only with the following categories of third party and only to the event necessary:

  • Service providers who perform human resources, benefits administration, payroll, background check, and IT services on our behalf;
  • Government agencies and regulators when required by law
  • Professional advisors such as lawyers and accountants

All service providers are required to protect your personal information and use it only for the specific purposes for which it was disclosed.

Retention of Personal Information

Amy’s retains your personal information for as long as necessary to fulfill the purposes for which it was collected, including to comply with legal, accounting, or reporting requirements.  For job applicants who are not hired, we typically retain application materials for four years from the date of application to comply with equal employment opportunity recordkeeping requirements and to consider you for future opportunities.  For hired employees, we retain personal information for the duration of employment and for seven years following termination as required by law and for legitimate business purposes.  The specific retention period depends on the nature of the information and applicable legal requirements.

Your Rights

Pursuant to the California Privacy Rights Act (“CPPA”) and other applicable state privacy laws, you have the following rights regarding your personal information:

Right to Know/Access.  You have the right to request that Amy’s disclose what personal information we have collected, used, disclosed, and sold about you, including the categories of personal information collected, the categories of sources from which it was collected, the business purpose for collecting it, and the categories of third parties with whom we share it.

Right to Correct.  You have the right to request that Amy’s correct inaccurate personal information we maintain about you.

Right to Delete.  You have the right to request deletion of your personal information, except where such information is necessary to carry out a business purpose or comply with legal obligations.

Right to Opt-Out of Sharing and Targeted Advertising.  If Amy’s shares your personal information with third parties for purposes that constitute “sharing” under applicable law, you have the right to opt-out of such sharing. You also have the right to opt-out of the processing of your personal information for purposes of targeted advertising. “Targeted advertising” means displaying advertisements to you based on personal information obtained from your activities over time and across nonaffiliated websites or online applications. Right to Limit Use of Sensitive Personal Information.  You have the right to limit Amy’s use and disclosure of your sensitive personal information to only those uses necessary to perform the services or provide the goods reasonably expected by you, or as otherwise permitted by law.

Right to Non-Discrimination.  Amy’s will not discriminate against you for exercising any of your privacy rights.

Authorized Agents.  You may designate an authorized agent to submit requests on your behalf.  To do so, you must provide the authorized agent with written permission to act on your behalf, and we may require you to verify your identity directly with us.

Verification Process.  To protect your privacy and security, we will verify your identity before responding to your request.  The verification steps may vary depending on the sensitivity of the personal information and the nature of your request.

Response Timing.  Amy’s will respond to verified requests within 45 days of receipt.  If we require more time (up to an additional 45 days), we will inform you of the reason and extension period in writing.

Right to Appeal.  If Amy’s denies your request, you have the right to appeal that decision.  We will provide information about how to appeal in our response to your request.

Automated Decision-Making

Amy’s does not use automated decision-making or profiling that produces legal or similarly significant effects in our hiring or employment processes. All employment decisions involve human review and judgment.

Changes to this Privacy Notice

Amy’s reserves the right to update this Privacy Notice at any time and will provide you with a new Privacy Notice when and if any updates are made.  If Amy’s would like to use your previously collected personal data for different purposes than those it notified you about at the time of collection, Amy’s will provide you with notice and, where required by law, seek your consent, before using your personal data for a new or unrelated purpose.  Amy’s may process your personal data without your knowledge or consent only where required by applicable law or regulation.
