On Monday, a federal court in Alabama vacated Charles McCrory’s murder conviction and ordered a new trial. Charles has spent more than 40 years in prison for a crime he did not commit. In 1985, Charles was #wrongfullyconvicted for his wife’s murder based on discredited “bite mark” evidence. The forensic dentist who testified that Charles’ teeth matched the marks on his wife’s body has since recanted his testimony. “The bitemark evidence clearly prejudiced the outcome of McCrory’s trial, especially in light of the other evidence presented at trial,” wrote Chief U.S. District Judge Austin Huffaker Jr. in his order, giving the Alabama Attorney General’s Office 180 days to retry Charles or release him from prison. Although the Louisiana Supreme Court affirmed a judge’s decision finding Jimmie “Chris” Duncan innocent in June, the Ouachita Parish District Attorney’s office is seeking to retry him. Chris was wrongfully convicted of murder in the 1993 accidental death of his ex-girlfriend’s 23-month-old daughter, Haley Oliveaux, who was found unconscious in a bathtub. His conviction was largely based on discredited bite mark analysis from Michael West and a scientifically indefensible claim of sexual assault by Steven Hayne, notorious forensic experts who are responsible for at least nine other wrongful convictions. As part of their reinvestigation, prosecutors obtained a warrant for Chris’ DNA while also trying to obtain DNA from Haley’s mother, and plan to exhume Haley’s body nearly 30 years after her death.
