CMS Updates ABN Requirements – Are You Ready? On March 13, 2026, Centers for Medicare & Medicaid Services (CMS) announced approval of the updated Advance Beneficiary Notice of Noncoverage (ABN), Form CMS-R-131. While this may seem like a routine update, the implications for compliance, patient communication, and revenue integrity are significant. Key takeaways: • The updated ABN is effective immediately and valid through March 31, 2029 • Providers may use the previous version only until May 12, 2026 • After that, only the OMB-approved CMS-R-131 form is compliant Why this matters: The ABN remains a critical safeguard in Medicare fee-for-service. It ensures patients understand potential financial liability before services are rendered and enables providers to appropriately shift liability when claims are denied. However, improper use—or failure to use the updated form—can result in lost revenue and compliance exposure. Important reminders: • ABNs apply only to Original Medicare (FFS), not Medicare Advantage or Part D • They must be delivered in advance of services, allowing informed patient decisions • They are essential in scenarios involving medical necessity uncertainty or frequency limitations Action steps for providers: Now is the time to: ✔ Update ABN forms and workflows across your organization ✔ Educate front-end, billing, and clinical teams ✔ Validate that your documentation processes align with CMS requirements For laboratories and other diagnostic providers, this is particularly important given the complexity of coverage policies and frequency edits.
