How We Got Here
Last November, without any public hearings or debate, Congress included a ban on hemp products in the bill to reopen the federal government. President Trump signed it into law, and the countdown clock for our industry started ticking.
Without a legislative fix, hemp-derived THC products containing more than .4 mg total THC per container will become illegal nationwide on November 12, criminalizing the sale and possession of hemp-derived beverages and edibles, including Crescent 9 THC Seltzer and all Crescent Canna products.
We said we weren’t backing down. And this week, we got big news about the next step in this fight. Here’s where things stand — and what you can do!
Congress Now Has a Solution on the Table
Representatives Andy Barr (R-Ky.) and Angie Craig (D-Minn.) have introduced the Lawful Hemp Protection Act, bipartisan legislation that would replace the November ban with a federal regulatory framework for hemp products.
Instead of prohibition, the bill establishes robust regulations, including:
- Age verification requirements (21+)
- Federal labeling and packaging standards
- FDA-established serving limits based on research
- A ban on dangerous synthetic cannabinoids
- Federal permitting structure for hemp-derived beverages
- Protections for interstate commerce
This bill offers broadly popular regulations to ensure the industry continues to operate safely for consumers and productively for small businesses. We need every senator and representative in Congress to protect businesses and jobs in their communities by supporting this legislation in whatever form it takes.
The White House Wants This Fixed
President Trump has publicly called on Congress to act on hemp, saying a fix would help American farmers and the millions of consumers who depend on these products.
In June, the White House Office of Management and Budget sent a formal letter to House Speaker Mike Johnson calling on Congress to revise the federal definition of hemp and ensure “fair treatment of hemp products.”
The letter specifically asked Congress to address the issue through the next must-pass spending package in September, referencing the Barr bill’s framework as the model for doing so.
Shooting for September
Standalone legislation rarely makes it through Congress, so a much more realistic path runs through the spending bill.
Congress faces a September deadline to pass government funding for fiscal year 2027. That bill has to pass, or the government shuts down. Attaching the Lawful Hemp Protection Act’s framework to must-pass spending legislation is the same mechanism that created the ban in the first place. And it’s the most likely way to undo it.
The White House has already said this is the approach they want.
That makes the next few weeks critical.
