William Mauke shared thisEvery once in a while cases come along that combine profession and passion. I've been following the SRAM v. Fox Factory X-Sync bicycle chainring litigation for a while now, as it definitely falls into that category. It's interesting to see the Federal Circuit uphold the PTAB's finding that one set of claims in this patent family is valid while finding a separate set of claims in the patent family is obvious and invalid despite the fact that SRAM used similar arguments with respect to both. It goes to show that a robust patent portfolio covering numerous aspects of key commercial products cannot be underestimated when it comes to protecting your marketshare.

It’s an interesting time (to say the least) to be an investor. From the growth equity seat we’re looking for the same fundamentals we’ve always invested behind – distinctive business models, customer love and persistence, and compounding revenue growth – but the debate around durability is white-hot. For the AI-native challengers: can they leverage initial wedges of engagement to outflank entrenched incumbents? For the incumbents: can the combination of incumbency plus accelerated product innovation withstand the challenger onslaught? It was fascinating to hear from Brian and Rocio how our peers in venture are approaching these questions. The ground is shifting quickly... Thanks to John and Baker Tilly for hosting!

We’ve been through everything together since we met in middle school…from high school prom to young adulthood, first jobs, marriage, building our careers, growing from an apartment to a condo to a house in the suburbs to a house at the beach, two kids, our first dog then our second, losing both my parents, a cross-state move, to starting our own businesses. Today marks a big day. We hired our first employee for Chris’ electrical business 🎉 I’m proud of us 🥰

Since 2002, I have focused my efforts on helping clients successfully navigate their intellectual property (IP) challenges in a variety of technological areas including, but not limited to, chemical, pharmaceutical, mechanical, computer/software, and consumer products. I thrive on troubleshooting IP issues. I also enjoy being an advisor to clients when they need assistance in identifying, protecting, and leveraging their IP. I have a special focus on the patent process, as I am a registered patent attorney. The patent system can be complicated, and I help clients be more comfortable and understand what inventions they can protect and how best to protect them. I don’t think we can ask law firms for value-based pricing and a share of their AI savings at the same time. The GC whinge that the billable hour prices work on input costs rather than client value is well-trodden and one I’ve made myself in the past. Now that AI is starting to cut those input costs, plenty of us want the bills to fall with them. We saw that nearly four in five in-house lawyers in Juro’s State of In-House survey this year said firms using AI to work faster should charge less. The Financial Times reported earlier this month that Citi, Goldman and Morgan Stanley are telling their panel firms the same thing. That’s still an input cost argument though. If pricing should reflect value, a firm whose advice brings equal value in a fraction of the time should be entitled to keep the extra margin. You can’t have your cake and eat it. And if we do want to argue about input costs (and I don’t think we do if we really believe in value), we have to look at all of them. Not every cost is going down. Alexandra Smyth, GC for RELX Corporate, made the point in an interview with Corporate Counsel this week that lots of firms are now paying for AI tooling they never needed before. I haven’t solved this. Every value-based model I’ve thought through ends up as some form of fixed fee. Fixed fees are good at sharing downside risk with clients: firms absorb the cost of overruns. But they’re terrible at sharing upside when the advice turns out to be more valuable than anyone expected. A better value-based model would give firms a reason to contribute to upside. I’m also not sure how that works on corporate transactions. Outside counsel acting for a target have little influence on commercial terms agreed in principle up front, and the only real price movement after they’re involved is chipping on the back of diligence. Maybe it fits disputes or regulatory work better, where the outcome is easier to quantify. Have you ever agreed a pricing model with a firm that shares upside as well as downside?
